Why I Don’t Promise Every Non-US Founder an EIN in 24 Hours

If you are a founder outside the United States, you have probably seen promises like “Get your EIN in 24 hours.” I understand why that sounds attractive. When you build a business from another country, every extra step can feel like friction. You want your company formed, your EIN ready, your bank account open, and your payment systems working quickly.

But after working with international founders, I have learned that a blanket 24-hour EIN promise is not always realistic. The process can depend on where your business is based. It can also depend on how you submit the application and which IRS process applies to you.

Why I Don't Promise an EIN in 24 Hours

Not every EIN application follows the same process. The IRS provides different application methods based on the applicant's circumstances. Your principal place of business is one important factor.

Eligible applicants with a principal place of business in the United States or its territories can use the IRS online EIN application. When the online application is available and completed successfully, the EIN can be issued immediately. However, the IRS says applicants whose principal place of business is outside the United States cannot use the online application.

International applicants can use other methods. These include telephone, fax, and mail. Fax applications are generally processed within about four business days. Mailed applications can take approximately four weeks.

That difference matters to founders in India, Pakistan, the UAE, the United Kingdom, Nigeria, and many other countries. Owning a US LLC does not automatically mean that a non-US founder can use the same EIN process as a US-based applicant.

So I think there is a better question than “Can you get an EIN in 24 hours?”

Ask this instead: “Which EIN application process applies to my business, and what timeline should I realistically expect?”

The EIN Process Depends on Your Situation

A US LLC Does Not Automatically Make You a US-Based Applicant

One common misunderstanding is that forming a US LLC makes you equivalent to a US-based business for every federal process.

It does not.

You can own a US LLC while living and working outside the United States. Your company may be formed in a US state while your principal place of business remains outside the country. That distinction can affect how you apply for an EIN.

Different EIN Application Methods Have Different Timelines

The IRS provides different ways to apply for an EIN. Your eligibility determines which method you can use.

For eligible applicants, the online process can be very fast. International applicants who cannot use the online system may need to use another IRS-approved method.

The IRS currently lists telephone, fax, and mail options for international applicants. The timeline depends on the method used. Fax applications are generally processed within about four business days. Mailed applications can take approximately four weeks.

The important point is simple: the fastest possible timeline is not necessarily the timeline that applies to every applicant.

What I Learned From Working With International Founders

When I first started helping entrepreneurs create US companies, I focused on getting things done quickly. Speed matters in business. I also understand why founders want certainty when launching a company.

But experience taught me an important difference. Moving quickly is not the same as promising something you cannot control.

The IRS is responsible for issuing the EIN. A service provider can help prepare the required information. We can also explain the process and help submit the application through the appropriate channel.

What we cannot honestly guarantee is that every application will be processed within the same number of hours.

For international founders, this difference is especially important. The IRS provides different application options based on the applicant's circumstances.

An EIN Is Important, But Speed Isn't Everything

Many founders focus heavily on getting the EIN. Sometimes they forget to ask what they actually need it for.

An Employer Identification Number (EIN) is a federal tax identification number. Businesses use it for federal tax purposes. Depending on the business, an EIN can also be relevant to banking, hiring, tax filings, and other requirements.

But receiving an EIN does not automatically mean that your company is ready to operate.

The application must contain accurate information. Your company structure matters. Your circumstances matter too. After receiving an EIN, you may still have federal, state, or other tax and compliance responsibilities.

This is something I have become more serious about over the years: a founder should understand what they are getting, not just how quickly they are getting it.

Why I Would Rather Be Honest Than Say “24 Hours”

I know that “EIN in 24 hours” is an easy marketing message. It is short and sounds certain. For someone launching a business, that promise can be very appealing.

But working with international founders has taught me that trust matters more than a catchy promise.

If an EIN can be obtained quickly through the applicable IRS process, we should move quickly. There is nothing wrong with being efficient.

But some applications require another process. Some may also take longer. In those situations, I would rather tell the founder the truth than create an expectation that may not match reality.

That philosophy goes beyond EINs.

When you help entrepreneurs from different countries build businesses in the United States, you are dealing with their money, time, plans, and ambitions. Those things deserve accurate information. They should not depend on promises designed only to make a service sound faster.

What I Tell Non-US Founders Today

My advice is simple: don't choose an EIN service only because it promises the fastest possible timeline.

Instead, ask how the application will be handled. Ask what information is required. Ask which IRS process applies to your situation. Also ask what happens if the application takes longer than expected.

It is also important to understand the difference between company formation and ongoing compliance. Forming an LLC is only one part of establishing a US business.

Your company, ownership structure, activities, and state can affect your ongoing requirements. You may have additional federal or state obligations after formation.

Don't Confuse Speed With Certainty

A US company can open doors for an international entrepreneur. But building a serious business is not about finding shortcuts at every step.

Sometimes the most valuable thing a service provider can say is not “Yes, we'll do it in 24 hours.”

Sometimes it is: “Here is what the process actually looks like. Here is what we can control. Here is what we cannot promise.”

That is the standard I want to build FormLLC around.

I would rather have a founder trust me because I told them the truth. I would not want them to choose me only because I made the biggest promise.

A More Honest Approach to EIN Services

For international founders, the goal should not simply be to find the shortest advertised timeline. The goal should be to work with a provider that understands the process.

A responsible EIN service should explain the application process. It should collect the required information. It should use the appropriate submission method. It should also communicate clearly about what happens next.

Fast service is valuable. Honest expectations are even more valuable.

That is why I don't promise every non-US founder an EIN in 24 hours. I would rather explain the process clearly and help you follow the correct path.

A realistic timeline may not sound as exciting as a 24-hour promise. But it gives founders something more useful: a clear understanding of what to expect.
